Terms & Conditions

For the purpose of these terms and conditions:


‘AUQA’ means the Australian Universities Quality Agency Pty. Ltd.
'Database' means the AUQA Good Practice Database available on the AUQA web site;
‘Site’ means that part of the AUQA web site which contains the Database; and
‘Validating Body’ means AUQA or another party approved by AUQA, which has independently validated the Good Practices through national or state systems for audit or accreditation.
‘Entry’ means information pertaining to a particular Good Practice stored within the Database.

  General Terms for Use of Database

 

Your access to and use of the Site, either on your own behalf or on behalf of the organisation you represent, is subject to these terms and conditions. AUQA reserves the right to change these terms and conditions at any time by posting the changes to the Site. You are responsible for regularly reviewing these terms and conditions to obtain notice of such changes. Your continued use of the Site after any such change constitutes your acceptance of those changes.

  AUQA Good Practice Database

 

The Database was developed and is managed by AUQA. The Database is intended to make information about good practices in the Australasian Higher Education sector (the ‘sector’) publicly available. It is intended that such information will serve as a general guide to the sector to assist it in its efforts to improve. The Database is not intended to present ‘standards’ for the sector nor will AUQA audit an institution/agency against entries in the Database.

 

The Database is populated with practices deemed by AUQA and other Validating Bodies to be suitable for inclusion. Whilst AUQA and other Validating Bodies make reasonable efforts to select good practices for inclusion in the Database, to the extent permitted by law, AUQA and other Validating Bodies will not be liable for:

  • any errors or omissions in, or the availability of, the Database;
  • any action or inaction that an individual or organisation may take on the basis of the content contained in the Database;
  • any loss, injury or damage (including but not limited to direct, indirect or consequential loss) sustained as a result of any action or inaction by an individual or organisation based on the information contained in the Database.

AUQA has compiled the Database in good faith and has endeavoured to ensure that all content is accurate and does not breach any third party rights at the time of its inclusion. However, such content may contain unintentional errors and the Site is made available to you “AS IS” without any warranty or representation:

  • in relation to the quality, operability or availability of the Site; or
  • that this Site will not cause damage or loss or does not contain any computer virus or any other error or defect.

The hyperlinks displayed within the Good Practice entries on the Site are provided for convenient reference only. If you choose to follow any hyperlink you will be leaving the Site. AUQA does not control or endorse the content of any other web site and accordingly takes no responsibility for such content and will not be liable for the use of any hyperlinks.

  Copyright and Trade Marks

 

Intellectual property rights (including copyright) that subsist in the Site and its contents are owned by or licensed to AUQA. Subject to the Copyright Act 1967 (Cth) (or any other applicable legislation), you may not reproduce, adapt, store, communicate or distribute the Database or any part of the Database, other than for its stated purpose, without the prior written consent of AUQA. You may not sell the database or any part of the database. The images, logos, names or trade marks on the Site which identify third parties, their products or services, belong to the relevant third party and are used with their permission. This Site does not confer any rights in respect of images, logos or names.

  General Limitation of Liability

 

Without limiting any other clause in these terms and conditions AUQA will not be liable for any loss or damage however caused from the use or inability to use the Site and will not be liable for any incidental, special or consequential damages of any nature arising from the use or inability to use the Site. Where liability cannot be lawfully excluded, AUQA’s entire liability and your exclusive remedy is re-supply of the site or its contents.

  General

 

If any of these terms and conditions are deemed to be illegal or unenforceable then such term will be severed and deleted and the remaining terms and conditions will continue to be binding and enforceable. These terms and conditions are governed by the law of Victoria Australia and any dispute arising from them will be subject to the jurisdiction of the courts of Victoria Australia.
